Abstract
The article offers information on judicial decision of the Supreme Court of Canada in the case of Progressive Homes Ltd. v. Lombard General Insurance Co. of Canada, in which the Court addressed the issue of an insurer's duty to defend its insured general contractor under the commercial general liability (CGL) policies. It analyzes the British Columbia Supreme Court's decision in Swagger Construction Ltd. v. ING Insurance Co. of Canada case for construction deficiency claims under CGL policies.
