Abstract
The article discusses aspects of the employment law wherein the employer failed to ensure health and safety of its employee and the use of protective equipment which resulted in workplace fatality. Servisair had to face regulatory prosecution for the fatal accident of its employee, Murgappa Naiker, after falling from an open bucket while de-icing an airplane in Calgary. The company was burdened to prove that it took reasonable steps or due diligence to prevent the accident from occurring..
