Item Open Access Constitutional Rights to Supervised Drug Injection Facilities in Canada(International Review of Law, 2013-02) Bowal, Peter; Horvat, KelseyOn September 30, 2011, the Supreme Court of Canada ordered the government of Canada to continue to exempt Vancouver's supervised narcotic injection facility from Canada's criminal drug laws. The controversial clinic, known as Insite, had operated for eight years in one of the country's most socially troubled and economically challenged neighbourhoods struggling with addictions to illegal drugs. Insite was the first of its kind in North America, although supervised drug injection facilities continue in Europe and Australia. In this article we describe what the court accepted as the factual outcomes of this clinic and the constitutional basis for this judicial rejection of government health and criminal policy. We also consider the implications of this decision for similar facilities across Canada. (LRC), 2013-01) Bowal, Peter; Horvat, KelseyThe article discusses a court case wherein Wayne Crookes, a British Columbia businessman, sued website owner Jon Newton for posting two hyperlinks to allegedly defamatory articles about him. The Supreme Court of Canada concluded that there was no publication of defamatory on Newton's part. As stated, these offences were enacted in the late 1800s and these are blasphemous libel, defamatory libel and corrupting children. It informs that blasphemy has been a crime in Quebec and was a mechanism for social control, defamatory libel has been a crime in 1275 and was enacted to prevent false rumors, and corrupting children was enacted in 1918 to prevent children's adultery or sexual immortality.Item Open Access Whatever Happened To … The Prosecution of Susan Nelles(Legal Resource Centre of Alberta Ltd. (LRC), 2011-09) Bowal, Peter; Horvat, KelseyThe article discusses the life and experience of Susan Nelles, a nurse of Hospital for Sick Children in Toronto, Ontario. It notes her arrest for being accused as a killer of four babies including Justin Cook and Allana Miller due to the high concentration of digoxin in the babies blood. It highlights her procedural victory due to her courage to fight the system that wronged her and was awarded an honorary doctorate in law from Queen's University, for her work in promoting integrity in nursing.
